1. Agreement to Terms

By accessing, browsing, registering for, or using the Smarto AI platform (https://smartoai.fun), mobile applications, APIs, or educational tools (collectively, the "Services"), you agree to be legally bound by these Terms and Conditions. The Services are provided by Cyber Vision ("Merchant", "we", "us", or "our") in operational partnership with GNET Technologies and Smarto.

If you are accessing the Services on behalf of a minor (student in Grades 1 to 12 or competitive exam candidate), you represent and warrant that you are their parent, legal guardian, or authorized educator with full legal capacity and authority to agree to these Terms on their behalf.

2. Educational Services & Cognitive Lab

Smarto AI provides AI-assisted cognitive development exercises (SuperBrain OS 30 arenas), Socratic dialogue homework help, diagnostic mock tests, printable A4 worksheets, and computer-based test (CBT) simulations for NEET (UG) and JEE candidates. The Services are intended for educational supplemental training and skill enhancement.

3. User Accounts & Access Credentials

Users may register accounts as Students, Parents, Teachers, or Coaching Institute Directors. You agree to provide accurate, truthful, and complete information during registration. You are solely responsible for safeguarding your login credentials and password. Any actions taken under your account will be deemed authorized by you.

4. Subscriptions, Pricing & Payment Gateway (Razorpay)

Access to premium features, including full NTA NEET/JEE mock sets, Kota AI doubt solving, and advanced cognitive analytics, requires the purchase of a subscription pass.

• Merchant of Record: All payments are collected, processed, and invoiced by Cyber Vision.
• Payment Gateway: Online payments are securely processed through Razorpay and authorized Indian banking partners adhering to PCI-DSS Level 1 security standards.
• Currency & Taxes: All pricing is quoted in Indian Rupees (INR - ₹) and includes applicable GST unless explicitly indicated otherwise.
• Authorization: By completing a transaction, you authorize Cyber Vision via Razorpay to charge your selected payment method (UPI, Debit Card, Credit Card, Net Banking) for the stipulated fee.

5. Cancellation & Refund Policy

All purchases on Smarto AI are governed by our official Cancellation & Refund Policy. We offer a 14-day risk-free money-back guarantee for initial individual consumer subscriptions. Approved refunds are credited back to the customer's original payment source within 5 to 7 business days via Razorpay.

6. Intellectual Property Rights

All cognitive diagnostic tests, 3D STEM interactive simulations, algorithms, logos, graphics, and software architectures are the proprietary intellectual property of Cyber Vision, GNET Technologies, and Smarto. Users are granted a limited, personal, non-commercial, revocable license to access the platform and download educational worksheets solely for their own or their registered student's personal study.

7. User Conduct & Platform Integrity

Users agree not to: (a) reverse engineer, decompile, or tamper with the platform; (b) share account credentials with unauthorized third parties; (c) attempt unauthorized access to administrative consoles; or (d) misuse AI doubt-solving tools to generate malicious, illegal, or abusive content. Violation of this clause will lead to immediate account termination without refund.

8. Limitation of Liability

Smarto AI and its operating entities (Cyber Vision, GNET Technologies, Smarto) provide the Services on an "as-is" and "as-available" basis without warranties of any kind. While our mock papers are rigorously calibrated against official NTA patterns, we do not guarantee specific ranks, exam cutoffs, or admission outcomes in NEET, JEE, or school board examinations. Under no circumstances shall Cyber Vision or its technical partners be liable for indirect, incidental, or consequential damages.

9. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of India. Any disputes arising out of or in connection with the Services, billing, or these Terms shall be subject to the exclusive jurisdiction of the competent courts of law in India.
